Luxury Holiday Prepaid Package Rules

1. DEFINITIONS

“Company” means Club Retreat Hospitality Ltd., having its Regd. Office at E-261, Phase 8B, Sector 74 IT Tower, Industrial Area, SAS Nagar, Mohali – 160055 CIN U63040PB2020PTC052007, incorporated under the Companies Act,2013, which terms where applicable shall include its successors-in-interest and assigns. “Luxury Holiday Prepaid Package” or “LHP” means holiday package of six nights and seven days (only accommodation) on Premium locations in India and abroad. “Client” means any person(s) / company/firm who or which applies for LHP by executing the application form prescribed by Company.

“Package cost” or “Package Charges” or “Package Fee” means total fees payable towards LHP as per the option chosen by the Clients and as per price structure fixed by Company from time to time.

“Day/Nights” means a time interval between the check in time of a specified calendar date and the checkout time of the subsequent calendar date. “Blackout Days” shall mean days falling within period from 20th December to 10th January”.

“Down Payment” means the minimum upfront payment made by the Clients towards Booking Fee for LHP as fixed by the Company.

“Facilities” means the accommodation & activities in the affiliated Hotels, Resorts, Clubs and as listed by the company on its website fromtime to time.

“Customer” means any persons(s)/company/firm in whose name Confirmation Receipt has been issued after realization of the full amount by the Company. Client shall be categorized by the package such applicant has chosen, and such Client shall always be entitled for chosen Package.

“Taxes” means the taxes and levies as applicable and levied by Central Government/State Government/Local Authority on the charges payable interns as provided here under. –

“Complimentary Holiday Package” or “CHP” means Complimentaryplanexclusively for the Clients of LHPwith benefits and discounted cost as provided in clause 6 ofthis agreement.

“Rules” or “Package Rules” means the Package Admission Rules and the Package Usage Rules as framed by Company from time to time.

2. Grant of Luxury Holiday Prepaid Package- Executive.

An Applicant shall be considered for the grant of LHP on making the down payment to Company, however LHP entitlement shall start after the entire amount towards the LHP Charges is paid to Company. Company may at its discretion, agree to receive the LHP Charges in installments under a payment plan of Company. In case of payments made by installments, the Applicant shalldeliver post-dated Cheques / ECS and firstinstallment shall be considered as Down Payment. The Applicant binds itself irrevocably to pay the installment amount and undertakes to ensure due and prompt payment under theinstallment scheme.

The Clients shall comply with the obligation to pay the balance Package charges as per the agreed price structure and failure of which, shall amount to breach of contract by the Client and forfeiture of the entire money already paid.

All payments including Annual Subscription Fee (ASF) shall be made in favor of the Company only. An ID-proof needs to be submitted at the time of applying for LHP.

3. Entitlements of Luxury Holiday Prepaid Package- Executive:

A Client is entitled to enjoy a 6 nights and 7 days holiday during the period (maximum 1 year) subject to exclusion of Blackout Days as per PLAN opted, during the package usage period, provided the Client is not in breach of any of his obligation set out in the rules. Package entitles accommodation for a 2Adults & 2 kids below 12 years or 3 Adults. Client agree to comply with the rules prescribed under the opted plan, the chosen property and the company.

A Client is liable to pay the Package charges in full or installments under a payment plan of Company prior to availing the benefits under LHP.

4. Complimentary Holiday Package (CHP-Advance Nights)- Executive:

  1. The Client of LHP shall be eligible to opt for a complimentary holiday plan which entitles client to avail the same number of days and night as chosen under the LHP (to be availed in first year) for CHP years on payment of an annual Subscription fees which shall be payable every year and before usage of nights whichever is earlier. Such package is optional for the client, however, if opted, it shall be obligatory for the company to provide the services under CHP provided the Client has made payment of last all Annual Subscription Fee
  2. Under CHP, the Client can avail his/her its vacation at the property as applicable by giving a request for reservation by email only to reservations@test.clubretreathospitality.com and making his/her booking as All reservations & booking shall be done on a first come-first-serve basis and are subjects to eligibility as per the plan purchased and availability at the facility chosen. Request for reservation can be done from upto 3 months to 30 days prior to the commencement of holiday by sending an email on reservations@test.clubretreathospitality.com. Booking confirmed would not be canceled and would be treated as availed bookings.

With an intention to ensure that all customers get a fair chance of enjoying holidays at different Facilities, Customer may not be entitled to enjoy holidays at the same facility during the year subsequent to the year in which they availed a holiday at the facility in case the holidays are being sought at the same time by customers who have not availed holiday at the same facility in the previous Depending on the demand, company reserves the right to limit the number of persons c an be booked simultaneously during one holiday. In case package being held by the Firm/Company, the number persons authorized to use the entitlement will be for every Firm/ Company for each package held.
  6. The customer can split his nights with a minimum usage of 2 nights per The Customer can request multiple rooms only subject to availability. The Customer can save his unused nights for future use up to 12 nights by clearings his/her ASF.
  7. The request for booking shall be emailed by the customer from his/her/its registered email ID to reservations@test.clubretreathospitality.com in the following format:- Package ID

Name & contact number of Main Applicant

Name of destination with Check-in/Check-out Date Name & age of travelers

  1. Under CHP Company reserve its right to make changes in the benefits available under the package or Implement new systems without affecting any of the benefits/rights of its Clients in order to provide flexibility to the
  2. Company may at its discretion permit up gradation/down gradation of package as granted under CHP into larger/smaller facility subject to availability and as per the terms and conditions prescribed by company from time to time

Under CHP; on confirmation of the availability of a particular hotel/resort and dates as requested by the Client, Company shall issue confirmation voucher specifying the reservation details including check-in and check-out time to the Client for enjoyment of the family holidays. The Client shall abide by the terms and conditions mentioned in the confirmation voucher. In all cases, where Company provides alternative accommodation or offers an extra holiday, the same shall be in lieu of the number of days confirmed in the confirmation voucher issued by Company.

  1. Client is allowed maximum stay of 6 nights and 7 days in year under CHP
  2. Notwithstanding anything stated herein above, Company shall not incur any liability if it is not in position to fulfill its obligation due to any war, civil commotion, force majeure, acts of God, order/ notification from any Court of Law or Government or any other reason beyond reasonable control of company.

5. PRIVILEGES

Clients can use the facilities along with his/her spouse in terms of LHP or CHP granted.

Company assures Clients of providing the Facilities of the quality as per plan chosen for the LHP of CHP and the Facilities listed may change from time to time as it shall be the continuous endeavor of Company to provide the best of the facilities within the range opted by the Applicant/Client.

The Client can gift his/her/its Facility subject to such terms & conditions as set out in Clause7.

The holiday requested for by the Client consequent to the above must be confirmed by Issue of a confirmation voucher by Company. All requests for holiday are subject to eligibility and availability.

6. ANNUAL SUBSCRIPTION FEE CHP -. (Complimentary Holiday Plan)

If the Client has opted for CHP then Client shall pay Annual Subscription Fees (ASF) levied for each year of the Package Plan period and applicable taxes/duties levied by states or central Government. ASF is subject to change based on Wholesale Price Index (WPI) / Consumer Price Index (CPI). Customer can not avail of his/her/its holiday entitlement unless the entire ASF due is paid in full. ASF is non refundable and non payment of ASF would amount to breach of contract.

For better service to its Clients, Company offers various hotel facilities, exchange bodies and company has its own booking procedures. Clients shall be given option to avail the services at the facilities having direct agreement with the company as well as the facilities offered by such procedures. If the Client chooses to avail the facilities offered under exchange, then Client shall have to pay in addition to the above charges, such exchange fee as informed to the Client at the time of booking. Such exchange fee shall be payable in advance at the time of booking. Payment has to be made by the Client in the manner as informed by company.

7. GIFTING

A Client can gift his/her/its Room Nights to his blood relation by paying no additional charges, however such facility to the client shall not be commercially exploited, failure of which shall be deemed to be breach of agreement entitling the company to terminate the agreement and forfeit the Package cost & ASF paid.

The authorized person in whose favor confirmation voucher is issued shall produce the photo identification proof of identity on request from Company. Any exchange fees payable for the facilities availed shall be paid by Client unless otherwise agreed.

Company shall have the sole right to refuse the gifting to any person provided

  1. Who had been previously refused LHP or CHP by Company; or
  2. If the client or the person to whom same being gifted refused to provide the details/documents required by the company

Clients can gift their LHP entitlement in case clients are not utilizing their Room Nights to which client is entitled as per the package chosen and only if the Clients themselves are entitled to such room nights/facilities and all dues of the Client has been paid.

9. GENERAL

Any payment made by the Client would first be appropriated towards the late fees/interest and thereafter if any amount is left then towards admission fees and balance if any would be appropriated towards the exchange fee and thereafter ASF and package cost.

All requests for holidays shall be subject to eligibility and availability, in case an option asked for by Client is not available, then Company’s obligation shall be limited to providing choice to Clients with alternate facility within the range of charges for the facility for which the Client is generally eligible. If Clients opts for such alternate facility it shall be deemed that Clients has availed the facility of his choice.

Company reserves the rights to modify/amend/alter the terms and conditions contained herein and/or impose additional conditions at its sole discretion.

The Clients shall enjoy holidays without causing any inconvenience or disturbance to other Clients/Guests of LHP or CHP or any other occupants of the applicable facility. Changes of address, if any shall be promptly informed to Company. In case, the Client shifts out of India then he/she has to pay such amount as fixed by Company from time to time towards increased administrative expenses in addition to the applicable ASF.

All correspondence from Company shall be addressed to the first name Applicant only. In case of inconsistency/contradiction in instructions or request for holidays, Company shall act upon the instructions/requests for the first applicant only.

Customer shall be liable to pay all taxes/ charge / levies statutory or otherwise imposed by or payable to any Government body or any other authority on Package cost/ASF or any other charge arising out of this purchase. To elaborate, customer’s liability to pay taxes shall include changes in rates to existing taxes either prospective or retrospective, enactment of new taxes etc.

Company reserves the right to enter into any arrangement with any company/person/firm/association of person (AOP) For provision of any additional services to the customers. The customers are entitled to use such additional services on payment of such charges/fees as may be applicable/prescribed by company from time to time.

Apart from these terms and condition as mentioned above, all other matters are applicable shall be binding on customer like any amendment or enforcement of the legislation causing additional application on company or Changing the nature of any activity undertaken by company or detriment of the company, then the provisions In this agreement to the extent the additional Obligations are imposed on the company and the provisions in this agreement and the extent the law applicable is changing in the nature of activity undertaken by the company would be considered as distinguished before enactment of amendment.

Customer confirms that Non other verbal/written promises or any other assurance in a deviation from this agreement have been made by the company’s personnel. If any transaction is delayed or affected all for the reason of incomplete or incorrect information, customer shall not hold the company responsible for any loss/damage/inconvenience caused due to the same.

Company, shall not be held for, and the vacationer here by waive any claims against company, for any damage whatsoever weather direct, indirect, special, punitive, exemplary, incidental, consequential or otherwise.

Company makes no warranty of any kind regarding any of the products and services provided. All products and services provided by company are provided ‘as in ‘ And without any warranty of any kind, either expressed or implied company expressly disclaim all Warranties and conditions.

10. Refund and Cancellation Policy:

Clients may terminate and cancel the package within seven days of purchase; however, a 32% deduction will apply to cover applicable charges.
